ACT Data EULA / Terms of Service
Last Modified: 10/19/2026
Information you provide to us…
We collect information when you install, subscribe to, or use ACT Data products and services, including information accessed from your practice’s PIMS. The information we collect includes things like the name of a pet owner or veterinarian, a pet’s name, pet health updates, mailing addresses, email addresses, and telephone numbers.
What we collect…
When you use our products and services, we collect data from your patient information management system (PIMS), including patient records, client records, and transaction records (“PIMS Data”). Account, usage, and device data from ACT Data products is governed by Patterson’s Global Privacy Notice. Each of our services is subject to your consent when you subscribe to the service, and each service may have its own terms and conditions. You can withdraw your consent at any time by unsubscribing from the service and discontinuing use.
What we do with the data we collect from Animal Health Providers…
For veterinary healthcare providers accessing our website, platform, data services, or other products, or downloading apps from our websites, we collect data in user accounts, and we may access, use and archive information, including patient records. We may provide your PIMS Data to third parties whose services you sign up for and that rely on ACT Data to extract that data, so those third parties can deliver the services you requested from them, as described under Third-party services below. Our websites, platforms, products, and apps may also each be subject to additional terms and conditions. In addition:
- We do not share personally identifiable information from your customers (including pet owner names, addresses, emails, telephone numbers, or health information on an individually identifiable animal), with any other veterinary healthcare providers, corporate veterinary groups, or anyone else, without your express consent to share that information. Your acceptance of a third party’s terms that authorize ACT to provide your PIMS Data to that third party is your express consent for that purpose.
- We may share your own data with you, as a veterinary healthcare provider, so you can use that information to deliver the best possible care to your patients.
- We share data analytics, based on de-identified information, with third parties. For example, this may include data such as total sales of a medication in a certain region or overall compliance percentages of animals with a particular disease, in order to identify trends in the market and inform overall animal care outcomes.
- You choose which third-party services to sign up for. ACT provides identifiable PIMS Data to a third party only with your consent, and you can withdraw that consent at any time, as described under Third-party services below.
PIMS Data rights…
By installing, subscribing to, or using ACT Data products and services, you grant ACT the following rights to your PIMS Data:
- Hosting. ACT may host, store, and process PIMS Data in the United States.
- Identified data. ACT may store PIMS Data together with the identity of your practice and the personal information of your clients for as long as you use an ACT Data product or service, or a third-party service that relies on ACT’s PIMS data extraction.
- De-identification. ACT may de-identify PIMS Data by removing all information that identifies, or could reasonably be used to identify, your clients (such as names, mailing addresses, email addresses, and telephone numbers) and your practice (“De-identified Data”).
- Ownership of De-identified Data. ACT owns all De-identified Data. You grant ACT a perpetual, irrevocable, worldwide, royalty-free right to create, retain, use, sell, license, and disclose De-identified Data for any lawful purpose. These rights survive termination of this EULA and of your use of ACT Data products and services.
- No re-identification. ACT will take reasonable measures to ensure De-identified Data cannot be associated with your practice or any individual, will not attempt to re-identify De-identified Data, and will contractually prohibit anyone who receives De-identified Data from attempting to re-identify it.
Third-party services…
Some ACT Data products extract PIMS Data to power a service you purchase from a third party. In those cases:
- You must accept both this EULA and the third party’s own terms of service or EULA.
- Where applicable law requires you to obtain client consent or authorization before PIMS Data is provided to a third party under this section, you are responsible for obtaining it.
- ACT will provide PIMS Data (other than De-identified Data) to a third party only if you grant that permission in the third party’s terms, and only to the extent those terms allow. If you do not grant that permission, or you later withdraw it, ACT will not provide your PIMS Data to that third party.
- The third party’s terms govern its use of the PIMS Data it receives. ACT is not responsible for the third party’s use of that data.
- The third party’s terms do not limit ACT’s rights under this EULA, including ACT’s rights to De-identified Data.
What we do with Pet Owner Data…
For pet owners accessing veterinarian services offered through ACT or otherwise using our services, we collect data to help improve your user experience, and help identify and close gaps in your animal’s care. Information we collect provides insights, which we help turn into action, which means healthier and happier pets!
- We share information with your veterinarian, including any medication or prescription diet purchases you make, so that it can be added to your animal’s medical records.
- We use your information to provide customer service to you, like checking order status or working with your veterinarian to confirm your prescription.
- We do not share your personal information in any way that is not covered in this policy without getting your consent first.
For legal reasons, we may share your personal information to comply with inquiries from governmental authorities, or to protect, defend, exercise legal rights or claims, in connection with end user license agreements, terms of service or other applicable agreements, or as otherwise required by law. If we are legally required to share your information, we will attempt to notify you, unless such notification would violate law or court order.
In the event of business transfer, if ACT is involved in a sale of assets, merger, acquisition, business transfer, or other change of control, we may share your information with other entities involved. We will require any such successor business entity to honor this EULA, and we will notify you of any significant changes that would affect your information within 30 days of such an event. In the event of a business transfer, unless we are otherwise required by law to retain or provide your information to the other entity, you may request that your information be deleted from our records. This does not apply to De-identified Data.
Managing your data
- Products. All use of products is subject to the user consent in the product’s subscription terms and conditions for each product. You can withdraw your consent at any time by unsubscribing from the product and discontinuing use.
- By Contacting Us. You can also contact us anytime at mydata@actdata.vet if you would like to change or update your personal information. In some cases, we may have to keep certain information for legal or business reasons.
- Personal information shall be retained only as long as necessary for the fulfilment of the purposes for which the information was collected, or unless there is a specific retention period required by law. Therefore, when you terminate the use of our products and services, your personal information that is no longer required to fulfill the delivery of our products and services, will be destroyed and deleted from our products and services and from our software and our Act Data platform. De-identified Data is not personal information and is retained as described under PIMS Data rights.
How we protect your data – Technical safeguards
The security and confidentiality of your information is extremely important to us. We have implemented technical, administrative, and physical security measures to protect your information. As part of our efforts to protect your information, we have technical safeguards in place across our products and services, which may include the following:
- Requiring a password or a unique token in order for you to access your personal information;
- Using firewalls to protect information held in our servers;
- Utilizing Secure Socket Layer (SSL) encryption in transmitting sensitive information to our servers;
- Limiting the number of personnel who have potential access to personal information; and
- Routinely backing up the systems to protect the integrity of personal information.
There is always some risk that an unauthorized third party may find a way around our security systems. In the event of a security breach, the first thing we would do is notify you. This notice would include what happened, what information was breached, what ACT is doing to respond, and who to contact with questions. You can expect a notification from us no later than 30 days after we have verified the incident, but in most cases, you will be notified earlier than this.
We comply with data privacy regulations applicable in the jurisdictions in which we operate. We review and may revise this EULA from time to time as we add new features and services, as laws change, and as industry best practices evolve. The latest version of this EULA, with the date of its most recent update, will always be available at https://eula.actdata.vet/. Please review it periodically, and especially before you provide any information to us.
This EULA applies to veterinary healthcare providers, pet owners, and other users of ACT Data products and services, and governs all PIMS Data. By installing, subscribing to, or using ACT Data products or services, you accept this EULA. Patterson’s Global Privacy Notice (https://www.pattersoncompanies.com/global-privacy-notice/) governs all other personal information Patterson collects, including account, usage, and device data from ACT Data products. If this EULA and the Global Privacy Notice conflict regarding PIMS Data, this EULA controls.
If you have any questions about this policy or our practices at ACT, please contact us.
